Johns Creek is not the only local government in Georgia that is fighting against adult entertainment businesses in their community. Floyd County, Georgia is fighting a battle to shut down the Entice Adult Superstore that has opened. Georgia Attorney General Thurbert E. Baker outlined his view on the case, concluding a state statute and a Floyd County ordinance being challenged should be upheld. The following quote from the Calhoun Times, summarizes his position:
In his brief, as a friend of Floyd County, Baker asserts that obscenity is not protected constitutionally and that “separation of sexually oriented businesses from residential neighborhoods … is sufficiently substantial or important.”
In Hiram, Georgia an adult business was denied a permit to operate in the proposed location. This case will be challenged in court.
Adult Business License Opposed in Paulding County (WSB Radio) — The Hiram City Council has denied a business license to a man who wants to open an adult video and bookstore in the Paulding County town.
Several hundred people, mostly from area churches, turned out for Tuesday night’s meeting, where the council adopted a zoning ordinance that strictly limits where adult businesses can locate.
Because that measure was passed before the license request for “Chubby’s” was heard, the council was able to deny owner Tom Hudson a permit, noting the location of his proposed store was not zone for that type of business.
Despite an outcry from residents in attendance, the council did not vote on a complete ban of adult businesses.
The attorney for the business owner believes the city’s actions are unconstitutional and he plans to challenge the decision in court.
